Payment - Invoice totals exceeding $5000 must be paid by direct deposit within 2 days of auction closing. Payment for invoices exceeding $5000 may also be made onsite via bank cheque. For invoices totaling in excess of $5,000 GraysOnline reserves the right to charge a deposit against the purchaser’s credit card to a maximum of $5,000 or 25% of the invoice total. Occupational Health & Safety Asset Removal and Reuse

GraysOnline warn buyers that all plant offered for sale at Auction may not be fit for use in a workplace. It is the buyers/users responsibility to ensure that it is brought to a state necessary to comply with the Occupational Health & Safety Act and is fit for purpose. The cost and responsibility for all aspects of asset removal lies with the buyer. All work carried out by the buyer or his/her agent must be in accordance with relevant site and/or industry conditions as well as to the instructions of GraysOnline Auctions and our vendor.

A summary of these types of enforceable requirements is as follows.

  • Persons under the age of 15 years of age will not be permitted on site unless accompanied and supervised by an adult at all times
  • Tradespeople eg electricians, plumbers etc will be required to produce relevant licence before commencing work on site
  • Forklift, crane drivers, riggers etc will be required to produce licence before commencing work on site
  • It is a condition of entry to site that all visitors comply with any directions given by GraysOnline staff or representatives
  • Work carried out on this site must be done in a manner compliant with all Occupational Health & Safety legislation
  • All power tools and equipment used on this site must be tested (tagged) safe for use in accordance with AS3760 service testing and inspection of electrical equipment
  • GraysOnline will specify, based on the hazards present on the site, the mandatory personal protective equipment required to be worn prior to approval being given for entry to the site, eg safety footwear, safety eyewear, hard hats etc

(a) Removal Process

All work carried out by the buyer or his representative in this removal process is to be undertaken by adequately qualified and insured persons. Insurance and trade certificates may be required to be provide. All work practices employed by the buyer or his representative during removals must comply to all regulatory requirements and/or those as required by the vendor.

Industrial Equipment Safety Warning

GraysOnline warn buyers THAT ALL PLANT OR EQUIPMENT OFFERED FOR SALE AT THIS AUCTION MAY NOT BE FIT FOR USE IN A WORKPLACE and it is the BUYER’S OR USER’S RESPONSIBILITY to ensure that it is brought to a state necessary to comply with the Occupational Health and Safety Act and is safe and fit for use in the workplace. Breaches of the Occupational Health and Safety Act carry penalties for people who PURCHASE and OPERATE UNSAFE EQUIPMENT without conducting a thorough safety inspection. Plant MUST be given a safety inspection prior to operation when it is purchased at Auction.

(a) Plant Hazard Identification Reports

In accordance with current VIC Occupational Health & Safety regulations, Hazard Identification Reports will be provided for all items meeting the definition of plant. These reports are available for inspection prior to commencement of the Auction. Reports for "high risk profile" items will be available from the Auction premises during the inspection period. Reports for "low risk profile" items (ie household appliances) are viewable at any time upon request.

Inspection Details

Inspection of the assets is highly recommended. Bids on assets in this sale should be made based on your inspection and assessment of the goods. Descriptions and photographs should be used as a guide only. If you are unsure do not bid as no refunds will be given.

Pick up can only be made once cleared funds are received. Purchasers cannot pick up until full invoice is paid. Goods can only be released with the correct information being supplied which includes Sale number, Lot number/s and Buyers name

With regard to the removal of plant items marked as “B” items on the catalogue, the area is still defined as a work site, and in accordance with the requirements of the Vic OH&S Act 2004, these activities must be conducted in a safe manner.

In order to manage and minimise site risks, we recommend that you contact either of the following contractors :

However, if you choose to appoint your own contractor, their site activities must be in accordance with the attached contractor procedures. In particular, there is a requirement to:

  • 1.Complete the insurance details
  • 2.Review the attached site procedures
  • 3.Complete a JSA (Job Safety Analysis) for the safe removal of the plant item.

Any items remaining uncollected after the nominated collection times will be deemed abandoned

Assets can be collected Monday 31st August 2009 between 9.00am to 4.00pm. To collect your purchases please attend the collection address during the times advised with a copy of your winner’s e-mail and photo ID. A copy of your invoice will be on site with GraysOnline staff to assist in documenting the removal process. If you intend to send a third party to collect your goods on your behalf, you need to send them with a copy of your winner’s e-mail along with a photocopy of Driver/ 3rd Party pick up photo ID and signed note of authority permitting GraysOnline staff to release your purchases to the third party.

Once assets are removed the transaction between GraysOnline and the bidder is deemed complete. There will be no recourse beyond this time, even in the event of third party collections. If you are unsure please refrain from bidding.

IMPORTANT INFORMATION: Please note it is the purchaser’s responsibility to ensure the safe removal of their lots. Provide suitably qualified personnel to remove their lots. Some lots may be electrically hard wired or services such as air, water, gas or oil may still be connected. Occupational Heath and Safety regulations apply to this site. Third Party Pick Up

If you intend to send a Third Party to Collect your Goods on your Behalf, you Need to Send them with a Copy of your Winner’s E-mail, a Photocopy of Driver/3rd Party Pick Up Photo ID and Signed Note of Authority Permitting GraysOnline Staff to Release your Purchases to the Third Party. Alternatively, Email - susanp@grays.com.au or fax all relevant documents to 03 8552 4400 with the required information to ensure a speedy and efficient collection. The information needed is:

  • Sale and Lot Numbers e.g. 002-60325
  • Buyer’s Registered Name and/or Email
  • Transport details: Company Name, Contact Person and Job Number provided by the transport company.
